WHEN YOU WILLINGLY PLACE AN ORDER THROUGH THIS WEB SITE OR ANOTHER APPLICATION OR DEVICE ON WHICH THESE TERMS APPEAR, YOU ACKNOWLEDGE AND AGREE TO BE BOUND BY ALL OF THE TERMS STATED HEREIN. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT PLACE AN ORDER.

You must be at least 18 years of age (or the age of majority in your jurisdiction of residence) to place an order. We reserve the right to update these Terms and will provide notice of any such updates by posting a new effective date at the top of these terms.

1. PLACING A NON SUBSCRIPTION ORDER

Non subscription offers may be made available to you. When you place an order for a non subscription Item, we will charge the credit or debit card you provide according to the payment amount specified on the order page. Charges may include the cost of the Item and a non-refundable shipping and handling fee. All dollar amounts are stated in U.S. dollars. Prices are subject to applicable taxes. Please refer to Section 3 below for information about our order return policy.

2. RECURRING SUBSCRIPTION OFFERS

If you sign up for a product on a subscription basis, and choose not to contact customer service to cancel further shipments, our recurring shipping program will ship you a fresh one-month supply of the Product beginning approximately every 30 (thirty) calendar days until cancelled. When each supply ships, we will automatically charge $89.75 USD plus $4.95 shipping and handling (for a total of $94.70) for Hexofire Delta Prime and/or $84.75 USD plus $3.95 shipping and handling (for a total of $88.70) for Hexofire Nitric Oxide to the same card you provided when you signed up for the subscription offer.

BY PLACING YOUR ORDER FOR OUR SUBSCRIPTION OFFER, YOU AUTHORIZE US TO CHARGE FEES FOR THE RECURRING SHIPPING PROGRAM TO THE SAME CARD YOU USED WHEN PLACING YOUR ORIGINAL ORDER, UNLESS YOU CANCEL YOUR ACCOUNT OR PROVIDE US WITH UPDATED BILLING INFORMATION.

3. RETURN AND REFUND POLICY

You are eligible to return your Item or Product for any reason within thirty (30) calendar days of delivery for a full refund (minus shipping and handling). Please call customer service at the number outlined below to initiate your return and/or refund. All returns must be done using the Return Merchandise Authorization “RMA” number. Customer service can issue you an RMA and walk you through the return process.

Once we have received your package, please allow 1-2 business days for your return to be processed.

Refunds also take 1-2 business days to process. The credit will be posted to the original credit card that was used for purchase and may take up to thirty (30) days to appear on your statement after the refund has been processed. In the event that an electronic refund is unsuccessful a refund check may be issued.

4. 30 DAY PRODUCT SATISFACTION GUARANTEE POLICY

Our goal is to ensure you are completely satisfied with your purchasing experience. Depending on your reason for the return of the Product we have made the below options available to you:

i. Refund – If for any reason you are unsatisfied with your Product or Item purchase, you may contact customer service within 30 calendar days from the date you were charged for the Product to arrange a return according to the procedure outlined below (even if the Product is open). Once we have received your Product return, we will issue you a refund for the cost of the Product (less S&H). This is our 30-day product satisfaction guarantee.

ii. Replacement – If you ordered a Product, and it arrives with shipping damage or after the Product expiration date we will replace the Product right away free of charge.

Promotional Good returns will be evaluated on a “case by case” basis and are subject to exchange only.

Product returns must be done using the Return Merchandise Authorization “RMA” procedure outlined below. RMAs can only be issued within thirty (30) calendar days of the Product purchase date. For all returns, you must write the RMA number clearly on the outside of your return package and send the return shipment to the following address. We will not accept returns that do not have an RMA number clearly written on the outside of the package. We will not accept return packages marked “Return to Sender.”

ALL SHIPPING AND HANDLING CHARGES ARE NON REFUNDABLE. YOU ARE RESPONSIBLE FOR ALL RETURN SHIPPING AND HANDLING CHARGES WHEN SENDING THE PRODUCT BACK TO US FOR RETURN.

THERE IS NO RE-STOCKING OR RETURN PROCESSING FEE CHARGED BY US FOR ANY RETURNS.

If you decide to return your Product, your return package must be received at the return address specified above within sixty (60) calendar days after you receive the RMA number. If we do not receive your return package within that time period, the RMA number will expire and your Product will no longer be eligible for return.

By placing an order, non subscription order, or participating in the recurring shipping/subscription program, you agree that we and our owner(s), parent, subsidiaries, affiliates, agents, representatives, and employees will have no liability whatsoever for any injuries, losses, claims, damages or any special, exemplary, punitive, indirect, incidental or consequential damages of any kind, whether based in contract, tort, strict liability or otherwise, resulting from any use of the web site or other application, the recurring shipping program, or any product or service offered on this web site or application, any failure or delay by us in connection with the web site or application, the non subscription offer, the recurring shipping program, or any product or service offered on this web site, the performance or non-performance of the web site or application, the non subscription offer, the recurring shipping program, even if we have been advised of the possibility of damages. BINDING ARBITRATION 

ANY CLAIM OR DISPUTE RELATING IN ANY WAY TO YOUR ORDER, USE OF THE SITE OR OTHER APPLICATION OR THESE TERMS OF USE SHALL BE SUBMITTED TO CONFIDENTIAL ARBITRATION, except that either party may seek interim relief from any state or federal court in the party’s state of residence to protect the party’s intellectual property rights. ARBITRATION WOULD REMOVE YOUR RIGHT TO LITIGATE A CLAIM IN COURT OR TO HAVE A JURY TRIAL ON THAT CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IN COURT MAY NOT BE AVAILABLE IN ARBITRATION. NO CLASS ACTIONS

TO THE EXTENT ALLOWED BY LAW, WE EACH WAIVE ANY RIGHT TO PURSUE DISPUTES ON A CONSOLIDATED OR CLASSWIDE BASIS; THAT IS, TO EITHER JOIN A CLAIM WITH THE CLAIM OF ANY OTHER PERSON OR ENTITY, OR ASSERT A CLAIM IN A REPRESENTATIVE CAPACITY ON BEHALF OF ANYONE ELSE IN ANY LAWSUIT, ARBITRATION, OR OTHER PROCEEDING. YOU UNDERSTAND THAT BY AGREEING TO THIS CLASS ACTION WAIVER, YOU MAY ONLY BRING CLAIMS AGAINST HEXOFIRE LABS IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING.

IF YOU HAVE ALREADY PURCHASED A PRODUCT AND YOU DO NOT AGREE TO THE FOREGOING TERMS, YOU MUST TELL US IN WRITING AND RETURN THE PRODUCT TO GET A REFUND.

9. GOVERNING LAW

These Terms shall be construed and enforced solely in accordance with the laws of the Province of British Columbia, Canada, as applied to agreements entered into and completely performed in the Province of British Columbia (without regard to conflict of law principles). The state or local courts in the Province of British Columbia will have exclusive jurisdiction and venue over all controversies in connection with these Terms, and you hereby consent to such exclusive and personal jurisdiction and venue. Any claim you might have must be brought within two (2) years after the cause of action arises, or such claim or cause of action is barred. In addition, you agree to waive any right to a jury trial in connection with any action or litigation in any way arising out of or related to these Terms. You also acknowledge and agree that any applicable state law implementation of the Uniform Computer Information Transactions Act (including any available remedies or laws) shall not apply to these Terms and is hereby disclaimed. A printed version of these Terms and of any related notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent as other documents and records originally generated and maintained in printed form. 10. SURVIVAL

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be construed consistent with applicable law, and the remaining provisions shall be enforced.

These terms make up the entire Agreement between HexoFire Labs and you relating to your use of the Product(s) or Item(s), or use of this website. These terms replace any prior understandings or agreements (whether oral or written) regarding the Product(s) or Item(s)).
